Content Submission Rules - That's Who We R

Thank you for helping the National Association of REALTORS® ("NAR") celebrate the new Consumer Advertising Campaign, That’s Who We R! The campaign website www.ThatsWhoWeR.realtor (as redirected to https://www.nar.realtor/thats-who-we-r) (the "Site") is intended to be an enjoyable way to share member stories. NAR must ask that any submission to this Site, via email, the "Add Your Story" interactive feature, or otherwise, comply with the following Content Submission Rules (the "Rules") as well as the Terms and Conditions of Use for the Site. NAR reserves the right to change, update, revise or otherwise alter these Rules at its sole discretion. Please know that should you submit any content through this Site, that all licenses, covenants, agreements, acknowledgements and understandings contained herein are irrevocable.

Submissions

The Site permits NAR members to submit photographs ("Photographs") of them or their business. The submissions should also include a story (the "Story"), the relevant member (if applicable), the local association for the relevant member (if applicable), and contact information for the user submitting the story. You must agree to abide by the Site's Terms and Conditions of Use and these Rules in order to submit any Photographs or Stories (collectively, "Content").

Submissions may not contain any real estate listings or any advertisements, including without limitation, advertisements for real estate services, such as brokerage, lending, title insurance, property or casualty insurance, property management, building developing or consulting.

NAR encourages meaningful exchange of information on the Site. All Content submissions will be reviewed by a representative of NAR prior to posting to the Site. NAR reserves the right to refuse to post any Content to the Website or to remove any Content from the Website, in whole or in part, at its sole discretion at any time. NAR further reserves the right to edit, crop or alter the Photographs, or edit, revise or rewrite the Stories in its sole discretion.

Please remember that any submitted Content should not:

  • Contain knowingly false or fraudulent information;
  • Contain offensive or inappropriate language or images;
  • Consist of an advertisement, promotion, endorsement or solicitation, including spam;
  • Contain any links to third-party websites;
  • Infringe any rights, including intellectual property rights, privacy rights, or publicity rights, of a third party;
  • Violate any local, state and national laws;
  • Contain any viruses or corrupted files;
  • Include any defamatory, libelous, threatening, vulgar, sexually explicit, abusive, profane, rude, obscene or anonymous Content;
  • Disrupt or interfere with the normal use of the Site by other users; or
  • Impersonate any other person or third-party entity.

When you submit any Content to NAR, NAR may contact you for a variety of reasons, including questions regarding the submitted Content. You agree that NAR may contact you using the contact information you provide with your submission.

If you submit Content to the Site, you agree to indemnify and hold NAR harmless from any and all liability, damages or expenses whatsoever due, directly or indirectly, to any cause of action arising out of the Content submitted by you.

Please be sure to also read the Terms and Conditions of Use for the Site, which also governs your submission of any Content along with these Rules.

License Grant

By submitting any Content, you grant to NAR, its officers, directors, employees, agents, subsidiaries, affiliates, partners, third-party licensees and those working for it and on its behalf, a non-exclusive, non-revocable, worldwide, royalty-free, sub licensable, perpetual license to use the Content in any manner and for any purpose, including without limitation, the right to reproduce, display, perform, alter, distribute, sublicense, assign and commercialize the Content for any purpose whatsoever. This license will apply to the distribution and the storage of your Content in any form, medium, or technology now known or later developed.

If you are a member or association, you consent to NAR's use of your name and identification of your local association (if applicable) in connection with any use of the Content. NAR reserves the right, however, to use the Content with or without associating your name or other identifying information with it.

If you are submitting a story on behalf of a member or association, you confirm that you have obtained all necessary consents from the relevant member(s) and association(s) and the rights to submit the Content and undertake the obligations and duties herein.

NAR's Use of the Content

NAR may use the Content submitted by you at its discretion. Submission of any Content in no way guarantees that such Content will be made available on the Website.

NAR's decision to "share" Content on NAR's social media channels or otherwise acknowledge Content originally posted by someone else should not be interpreted as an endorsement or verification of the Content or the third party that posted it.

NAR does not guarantee the continued operation of this Site for any period of time. NAR may decide in its sole discretion to cease operation and deactivate this Site at any time. In such an event, any Content displayed on the Site will be removed. NAR is in no way responsible for archiving or maintaining any of the Content displayed on the Site, while the Site is in operation, after the Site has been deactivated, or otherwise.

Social Media

The Content you submit to NAR, if selected by NAR to appear on the Website, will be publicly available on the Website. Third party visitors to the Website may have the ability to share Content available on the Website, potentially including your Content, to their own social media sites and channels. NAR has no control over the sharing of Content to social media sites and channels by third parties, including any comments or remarks that accompany the shared Content.

Representations, Warranties and Indemnification

By submitting the Content, you represent and warrant to NAR that you have the legal rights to convey or license any Content you submit as set forth herein and in the Terms and Conditions of Use. By submitting Content to the Site, you warrant and represent that you either own or otherwise control all of the rights to that Content, including without limitation, all the rights necessary for you to provide, post, upload, input, or submit the Content, or that your use of the Content is a fair use, or that you may provide, post, upload, input or submit the Content as described herein, the Terms and Conditions of Use, and on the Site pursuant to a license granted to you for the Content.

You represent and warrant also that the Content you submit does not violate these Rules or the Terms and Conditions of the Use for the Site.

You agree to indemnify and hold NAR, its subsidiaries, and its officers, directors, employees and agents and those working for it and on its behalf, harmless from any and all third-party claims resulting from NAR's use of your submitted Content.

Discharge and Release

You understand that you are not entitled to any further compensation of any kind for NAR's use of the Content in any manner now or in the future. You fully and forever discharge and release NAR from any claim for damages of any kind (including, but not limited to, invasion of privacy; defamation; false light or misappropriation of name, likeness or image) arising out of the use or publication of the Content by NAR, and agree not to sue or otherwise initiate legal proceedings against NAR for such use or publication.
