Work Group Purpose
Develop a mediation procedure and ombudsman program to assist associations in resolving disputes.
Background
This work group was formed out of a need identified by the Collaboration Work Group, which identified the use of mediation and ombudsmen services as options for resolving association-to-association disputes. By identifying the dispute types and the specific processes for handling such disputes, the AEC leadership believes associations will be equipped to handle various disputes that arise between associations that are not currently contemplated by National Association policies.
Meeting Activity
Work group Co-Chair Sandy Naragon led the group in a discussion of where these mediation resources, once finalized, should reside. It was agreed to post them to the REALTOR®-to-REALTOR® mediation page on nar.realtor, as well as the AE page.
The group then reviewed the revised versions of the mediation tools they gathered and developed during their July meeting in Chicago. These include the Policy Violation Resolution Procedure (PVRP), the NAR model mediation process for association disputes, and the draft professional best practices.
The group discussed how to select the right mediator for an association-to-association dispute and agreed that NAR staff should prepare a checklist to help associations vet potential mediators so they select the right one for their association-to-association dispute. This checklist will include language that tells associations they can bring in their own mediators and they do not necessarily have to select one from the list provided on nar.realtor.
The group also noted that the PVRP has an exception with regard to contractual issues and that contractual issues are not covered by the PVRP.
Staff will make changes to all of the dispute resolution documents and then post them on the Hub for final comment from the work group. The work of this group concluded at this meeting and it disbanded.
