Phillip Schulman, noted RESPA authority, reviews MSA and ABA requirements and provides key dos and don’ts. Enforcement of the Real Estate Settlement Procedures Act (RESPA) by the Consumer Financial Protection Bureau (CFPB) has been on the rise and Marketing and Services Agreements (MSAs) and Affiliated Business Arrangements (ABAs) are squarely within the CFPB’s sights. Brokers and agents need to be sure their practices are RESPA compliant.
