Below are summaries of the case funding recommendations made by NAR's Legal Action Committee, which were subsequently approved by the Board of Directors at the 2015 REALTORS® Legislative Meetings and Trade Expo, held in Washington, D.C., during May 2015.

NAR provide funding of $180,000 in two cases for which assistance was requested, as follows:

a. POI Search Solutions, LLC v. Fathom Realty, LLC (TX)

POI Search Solutions filed a patent infringement lawsuit against Fathom Realty asserting infringement of a patent that allegedly covers “displaying points-of-interest” on a digital map, such as the display of homes for sale on a website.  POI alleges that Fathom violates the patent because its website provides users the opportunity to search for and display properties on a map on its website.  Fathom argues that the patent is invalid as a non-patentable “abstract idea” and as insufficiently inventive based on existing prior art.  Fathom is planning to file a request for review of the patent with the U.S. Patent Office in cooperation with Keller Williams.

b. POI Search Solutions, LLC. V. Keller Williams Realty, Inc. (TX)

POI Search Solutions filed a patent infringement lawsuit against Keller Williams Realty, Inc. similar to the case described above against Fathom Realty.
