NAR Comments on FCC Proposal

NAR, in conjunction with a coalition of real estate groups, submitted comments to the Federal Communications Commission (FCC) this week on a proposal to expand 5g deployment. This proposal could impact the real estate market in two ways:

  1. It could provide an apartment resident or commercial tenant the right to install a 5G small cell or other wireless infrastructure on their balcony/within their leased space to not just boost their individual coverage/reception but to transmit the signal to other customers of the telecom provider by serving as a “hub”; and 
  2. It may allow a telecom carrier who already leases rooftop space from a property owner (for antennas, other equipment) the ability to attach a 5G small cell or other wireless infrastructure on that existing equipment without amending their agreement with the property owner.

NAR wants to ensure private property rights are retained throughout this process. The comments focus on urging the FCC to refrain from extending the Over-the-Air Reception Devices (OTARD) rule and permit the installation of antennas or similar devices on leased property without the consent of the owner.
