Property Rights and the Supreme Court: New Cases and Dramatic Decision

11:00am – 12:00pm, Orange County Convention Center West, Room W308 C

Over the past five years the Supreme Court has heard several cases with important property rights implications. Cases such as Hawkes v. U.S. Army Corps of EngineersSackett v. EPA and Murr v. Wisconsin have all addressed property rights and regulatory overreach in some way.

The first two cases were unanimous decisions that allow property owners to challenge the federal government when they subject private property to federal control. The Murr v. Wisconsin case challenges the government scheme that allows them to not compensate private property owners when they prohibit all economic use of a parcel because the property owner happens to also own an adjoining parcel.

The Pacific Legal Foundation has been at the center of many of these Supreme Court cases and has represented the property owner before the Court on several occasions. John Groen, PLF’s General Counsel and principal attorney in the Murr case that was just heard at the Supreme Court, will provide information and insights on these cases. He will summarize where he sees the Supreme Court going in the short term, and what it’s like to argue a case before the Supreme Court.
